内容摘要 【摘要】打击犯罪和保障人权同样都是我国刑事诉讼法的重要任务，在刑事诉讼的 制度构建和实践操作中应当作出合理的平衡。在 2012 年《刑事诉讼法》修订完善的过 程中对五种强制措施之一的监视居住进行了改进，提出了指定居所监视居住的概念。无 论从限制政府公权力的角度还是从保障公民私权利的角度出发，“通知家属”具有极其 重要的作用。在制度设计和实际操作中，指定居所监视居住这一制度中通知家属上存在 以下七方面的立法缺陷：未准确界定“无法通知”的具体情况；通知家属的时间不明确、 不及时；通知家属的方法自由适用；通知家属的起算时间司法机关规定不一致;通知家 属的内容不确定；通知家属的对象范围小；权利救济不足。 【关键词】指定居所监视居住 通知家属 权利保障 3 万方数据 Abstract On crime and safeguard human rights also is an important task of the criminal procedure law in our country, in criminal lawsuit system construction, and shall make a reasonable balance in practice.
