题目：FIDIC施工合同条件下工程变更 及价款调整问题研究 Research?on the ariation and Price Adjustments under the FIDIC Construction Contract Conditions FIDIC施工合同条件下工程变更 及价款调整问题研究 摘要 FIDIC施工合同条件是目前国际上使用最广泛的合同文本。我国在引入FIDIC施工合同条件以后，对它的研究和应用也是由浅入深，尤其在我国的国际土木工程项目中，得到了广泛的应用。FIDIC合同条件在处理工程变更与价款的调整方面有着有专业性、权威性和公平性，通过对其研究，更有利于对工程变更与价款调整问题的解决，并保证工程的顺利进行。 本文在研究FIDIC合同条件工程变更及价款调整问题的基础上，了解FIDIC合同条件下变更与价款调整的具体操作方法与需要注意的问题，希望对施工过程中的变更及调价问题处理有所裨益。 对于FIDIC合同条件下变更问题的研究,是在利用文献中提到的工程变更问题原因、分类及处理过程的基础上，并结合现有合同文本对于工程变更的有关规定，分析FIDIC合同条件下的工程变更、工程师处理工程变更的作用、工程变更估价的问题。主要是运用了文献总结法，流程图和鱼刺图等方法得出了FIDIC合同条件下变更的处理及估价的基本方法。 对FIDIC合同条件下价款调整的问题的分析，本文利用文献分析法和不同文本比较的方法，研究FIDIC合同条件下调价公式的因子的确定及调价公式的具体应用问题，目的在于在建设项目的实施过程中，发生变更或其他问题时能按照FIDIC合同条件下的处理方法及流程进行及时的处理和解决，保障工程的按照预期的投资目标进行并顺利完成。 关键词：FIDIC施工合同条件 工程变更 价款调整 Research on the Variation and Adjustments under the FIDIC Construction Contract Conditions ABSTRACT FIDIC construction contract conditions are the most widely used contract text at present internationally. After FIDIC construction contract conditions introducing into our country, its study and application are becoming more and more thorough, especially in our international civil engineering projects, FIDIC construction contract conditions have been applied widely. FIDIC contract conditions in the treatment of variation and price adjustments are profession, authority and fairness. Through to its research, it is more conducive to the variation and price adjustments problems and to ensure the projects go smoothly. Based on the study of the variation and price adjustments under the FIDIC construction contract conditions, understand specific operation method and problems needing attention of the variation and price adjustments under the FIDIC construction contract conditions, hope for it is good to dealing with variation and price adjustments problems during the construction process.
