California Model Bylaws Local Member Associations with All-REALTOR® Membership Current Version (Effective August 15, 2014) Prepared by CALIFORNIA ASSOCIATION OF REALTORS® Corporate Legal Department 525 South Virgil Avenue Los Angeles, CA 90020 Introduction The California Model Bylaws (“Model Bylaws”) are designed and intended for use by Member Associations in California. The Model Bylaws are drafted to be in compliance with the policies of the National Association of REALTORS® (“N.A.R.”) and California state law. Some associations may desire to adopt different bylaws or make minor revisions to these. If so, it is recommended that the Member Association have such bylaws or minor revisions reviewed by counsel and approved by N.A.R. prior to adoption. “REQUIRES VERBATIM ADOPTION BY MEMBER ASSOCIATIONS” Articles I, II, III, IV, VII, VIII, XIV, and XVI of these Model Bylaws are identified as requiring verbatim adoption by Member Associations. These are Articles that must be incorporated into a Member Association’s bylaws pursuant to N.A.R. policy. Questions are occasionally asked as to whether verbatim adoption means actual word for word adoption. While word for word adoption insures compliance with N.A.R. policy, minor revisions to these Articles may nonetheless be acceptable. If a Member Association would like to make minor revisions to these Articles, it is recommended that such minor revisions be reviewed by counsel and approved by N.A.R. prior to adoption.
