( ) 　20 10 年第 1 期 　　　　　 　　　　法律科学 西北政法大学学报 　　　 　　　　　　　　　 ·137 · ( ) ( ) 　文章编号 :1674 - 5205 20 10 0 10 137 006 证据法定与法定证据 ———兼对我国《民诉法》第 63 条之检讨 占善刚 (武汉大学法学院 ,湖北 武汉 430072) 〔摘 　要〕　在大陆法系民事诉讼中 ,为确保事实认定过程的客观及公正 ,法院进行证据调查应以法定的证据 方法为对象 ,严格遵循直接原则并保障当事人的在场权 ,此即证据法定的要求或意义所在 。与此相应 ,其民诉立法 乃依证据调查方式之不同 ,确立了不同的证据类型 。我国现行民诉法尽管在制度设计上贯彻了证据法定的要求 , 但关于法定证据类型的确立并不科学 ,突出表现为误将勘验笔录与视听资料作为独立的证据类型予以规范 ,亟待 修正 。 〔关键词〕　证据法定 ;法定证据类型 ;勘验笔录 ;视听资料 ;证据调查 Abstract :In t he civil p rocedure of t he Roman law sy st em , to en sure t he obj ectivit y and t he fairness of t he cour se of fact - finding , t he court s investigat e t he evidences should t ake t he st at utory mean s of evidence a s t he obj ect , to a bide by t he p rinciple of direct t rial rigidly , to safeguar d t he right to be on t he scene of t he p art y concerned , which are what t he evidence - legali sm requires and t he rep resent ation of it s significance . Accor dingly , t he civil p rocedure law est abli shed different t yp es of evidences , ba sed on t he different way s of evidence - investigation . The Civil Proce dure L aw of PRC implement ed t he requirement s of t he evidence - legali sm in t he in stit utional design , but t he p rovi sion s about t he t yp es of evidences are not scientificand t hey are out st andingly charact erized by t hat it wrongly stip u lat ed t he recor d of inquest and t he audio - vi sual mat erial a s indep endent t yp es of evidence , which shall be correct ed ur gently .
