本科毕业论文 论我国侵权死亡的精神损害赔偿 姓 名：王晨曦 学 院：法学院 系： 专 业：法学 年 级：2007级 学 号：13620078100236 指导教师（校内）：黄健雄 职称：教授 论我国侵权死亡的精神损害赔偿 [内容摘要] 随着《侵权责任法》的出台，我国终于在法律层面正式确定了精神损害赔偿制度，该法第22条规定：“侵害他人人身权益，造成他人严重精神损害的，被侵权人可以请求精神损害赔偿。”其中亦授予了侵权死亡案件的受害人亲属请求精神损害赔偿的权利。但该条仅是对精神损害赔偿的原则性的规定，精神损害赔偿制度的构成要件、侵权死亡案件与一般侵权案件的不同及其赔偿标准的计算方法等仍是司法实践中急需解决的问题。故本文将精神损害与精 神损害赔偿等基本概念入手，同时考察我国现行法律规定与国外相关制度，以发现我国制度之不足，并对相关问题提出完善建议。 [关键词] 侵权死亡； 精神损害赔偿 On the death of the spirit of tort damages [Abstract] With the Tort Liability Act, the introduction, China has finally officially confirmed in the legal aspects of mental damage compensation system, the provisions of Article two: infringement of personal rights and interests, resulting in severe mental harm to others, was the spirit of the infringer may request damages. infringement which also granted the death of relatives of victims the right to request compensation for moral damage.
