城市拆迁中的市民维权研究+文献综述 摘要：随着我国城市化、工业化进程的加快, 城市建设用地需求逐步增加,政府不断加大房屋拆迁力度，进而引发了城市拆迁中的市民维权行动。在城市拆迁过程中时常难免出现拆迁纠纷，当被拆迁户的利益受损时他们通常是如何维护自身合法权益的，本文通过对城市拆迁中市民维权现状的研究，揭示城市拆迁中市民维权所面临的诸多问题，从被拆迁户对现有补偿安置条件不满、被拆迁户对居住环境和熟人社区的不舍等方面分析城市拆迁中市民维权问题产生的原因。最后，针对引起被拆迁户维权的原因和城市拆迁中市民维权道路中的种种问题给出了四个方面的解决对策，分别是政府对拆迁制度的完善、引导市民运用法律手段维护自身合法权益、建立完善的利益表达机制和权利监督机制、社会工作介入被拆迁户维权行动。通过有效的解决对策期望改善城市拆迁中市民维权的现状，实现城市化的有序推进和整个社会的和谐稳定。5972 关键词：城市拆迁、市民维权、被拆迁户、社会工作 Safeguard civil rights in city demolition Abstract: The source of citizenrsquo;s action of maintaining legal rights during urban relocation comes along with the accelerating of urbanization and industrialization, the large demand of the land in urban construction and the increasing intensity of urban house dismantlement from local government. In the process of urban relocation, it often appears demolition disputes inevitably. In what way did the relocated households maintain their legal rights when their interest has been damaged? Through the study on the actuality of the citizen rights protection in urban demolition, this thesis will reveal the problems that exist in the actuality and analyze the source of those problems from the dissatisfaction to the existing conditions of compensation and resettlement of relocated households, the imperfect demolition system of government and the reluctant feeling of relocated households to leave living environment and their neighbors. Finally, focused on the reason of relocated householdsrsquo; action of maintaining legal rights and the problems that faced by citizen on their way to maintain their legal rights in urban relocation, there are four guiding principles for resolving those problems which is the improvement of governmentrsquo;s demolition system, guiding the citizens to use legal means to safeguard their legitimate rights and interests, establishing perfect benefit expression mechanism and power supervision mechanism and the intervention of social work in the action of maintain rights.
