唐 山 学 院 毕 业 论 文 论文题目：论我国民事诉讼公告送达制度 系 别：_________________________ 班 级：_________________________ 姓　 　名：_________________________ 指 导 教 师：_________________________ 2012年6月3 日论我国民事诉讼公告送达制度 摘要 公告送达作为我国法定送达的方式之一，具有独特的价值和功能。其价值在于通过公共媒体将诉讼信息传播出去，无论受送达人接收到与否都产生送达的效果，以此来推进诉讼程序的进行。然而当前立法过于抽象陈旧，实践中无法进行具体操作，法院和当事人往往会借此钻法律的漏洞，造成公告送达的滥用和错误适用，这直接影响到受送达人的诉讼知情权和参与权。而目前学界和立法机关对此还缺乏必要的关注。鉴于此，笔者通过考察我国公告送达制度的实际适用情况，从中找出问题并进行了深入分析。在合理吸取外国和其他地区立法经验的同时提出建立公告送达的前置审查机制，完善创新公告送达制度的内容，增加公告送达适用监督和异议机制等建议，希望能够重构公告送达制度，使其发挥应有的作用。 关键词：民事诉讼 公告送达 审慎适用 Chinas civil service by public announcement system Abstract Notice service as one of Chinas legal services, has the unique value and functionality. Its value lies in the proceedings to the dissemination of information through public media out, no matter if the person receive or not ,make the effect served ,as a way to promote the conduct of the proceedings. However, current legislation is too abstract and obsolete, unable to carry out specific operations in practice, the courts and the parties often take the legal loopholes, resulting in abuse and wrongly application , which directly affects the persons right to information and participation rights. The academic circles and the legislature lack of the necessary attention about it.In view of this, through the investigation of Chinas notice service system in the practical application, the author find out the problems and in-depth analysis.Reasonable to draw the foreign countries and other areas of the legislative experience , at the same time put forward to build preamp review mechanism, and improve the contents of the system of notice service, increase the supervision and the objection mechanism of notice service on its application, and hope to be able to reconstruct the public notice system and make it play its due role.
