最新工伤保险条约(New industrial injury insurance treaty)
(promulgated by Decree No. 375TH of the State Council of the Peoples Republic of China in April 27, 2003 and revised in accordance with the decision of the State Council on Amending the regulations on industrial injury insurance in December 20, 2010.)
Chapter I General Provisions
Article 1 in order to guarantee have suffered from work-related accidents or occupation disease workers receive medical treatment and compensation, promote the occupation injury prevention and rehabilitation, dispersing the work-related injury risks of employers of this set of regulations.
Enterprises, institutions, social organizations, private non enterprise units, foundations, law firms, accounting firms and other organizations within the territory of Peoples Republic of China and second individual businesses with employees (hereinafter referred to as employer) shall be in accordance with the provisions of this Ordinance to participate in work-related injury insurance, for all their employees or employees (hereinafter referred to as workers) to pay the work-related injury insurance premiums.
The organization of enterprises, institutions, social organizations, private non enterprise units, foundations, law firms, accounting firms in Peoples Republic of China workers and employees in individual businesses can enjoy treatment of inductrial injury insurance in accordance with the regulations of the rights.
The collection and payment of third work-related injury insurance premiums shall be carried out in accordance with the regulations on the collection of basic old-age insurance premiums, basic medical insurance premiums and unemployment insurance premiums in accordance with the Interim Regulations on the collection and payment of social insurance premiums.
Article fourth employers should be involved in work-related injury insurance within the unit publicity.
