课程设计论文 论文题目 责任保险中第三者的请求权问题研究 姓 名 学 号 所在学院 专业班级 指导教师 日 期  责任保险中第三者的请求权问题研究 摘要 责任保险是指以保险人对第三者依法应负的赔偿责任为保险标的的保险。 责任保险作为一类独立的保险业务，开始于19世纪中叶，发展于20世纪70年代，是随着社会经济发展、法律法规体系的完善和公民的维权意识的提高而逐步发展起来的。责任保险本身具有较强的社会管理功能，与社会生产和人民生活有着密切的关系。第三人的相关利益、第三人的请求权问题都是责任保险以及保险法的立法需要关注的重点问题。继2002年的《保险法》简要提到其相关条款之后，09年新修订的《保险法》也对其进行了完善和发展，但是，在贯彻落实《保险法》活动的过程中仍然存在一些问题和误解。 本文运用国内著名经济学家关于责任相关保险研究的优秀成果，再考察我国责任保险发展现状，分析相关案例后，全面探讨我国责任保险在第三者请求权的问题处理上存在的问题，为责任保险的进一步发展，以及更好的处理第三者的请求权问题提出了相应的建议。 关键词：责任保险，保险法，第三者，请求权 Study On The Right To The Third Request Liability Insurance Abstract Liability insurance refers to the liability of the insured to the third party is the object of insurance.Liability insurance as a separate class of insurance business, which began in the mid-19thcentury, developed in the 1970s,with the improvement of the socioeconomic development,improvement of the legal system and civil rights awareness and gradually developed. Liability insurance itself has a strong social management functions, and social production and peoples lives are closely related. The relevant interests of a third person, the right to request third party liability insurance and key issues are insurance law requires legislative attention. Following 2002s Insurance Law brief mention of its relevant provisions, in 2009 the newly revised Insurance Law also be the improvement and development, but in the implementation of the Insurance Law campaign in the process there are still some problems and misunderstandings .
