1 2 听审请求权是当事人的一项程序基本权利, 听审请求权保障是现代民事诉讼的一个重要的宪法理
念 民事诉讼中, 保障当事人的听审请求权体现了对人的主体性和人格尊严的尊重; 有助于实现程序公正和实
体公正; 使判决产生正当化的效果, 增强人民对裁判的信赖度; 为判决的既判力提供根据听审请求权由陈述权
证明权到场权辩论权意见受尊重权等内容组成为保障当事人的听审请求权, 我国应当着重做到: 民事诉讼法
上确立听审原则加强法官的释明权进 一步公开法官的心证完善当事人收集证据的保障机制改进送达方式

A bstract: The right to be heard is a rocedural basic right of the arties, the rotection of the right to be heard is an
mi ortant constitutional ideal ofm odern civil rocedure. The rotection of the arties. rights to be heard reflects the res ect
of the individual subjectivity and dign ity; it hel s to realize the fairness of rocedure and substance; it hel s tom ake a rea-
sonable judgm ent, strengthen the eo le. s conviction of the judgm en t; it also gives the foundation to the vested effect of the
judgm ent. The righ t to be heard consists of the right of statem ent, testification, resentation, argum ent and the res ect of
the advice etc. In order to rotect the arties. righ ts to be heard, our country should lay great em hasis on found ing the
rinci le of the right to be heard, strengthening the ex lanatory ower of the judge, o en ing the d iscretionary evaluation of
the judge further, mi roving the rotective system of the arties collecting evidences and transform ing thew ay of the deliver-
y.
