铁路旅客意外伤害强制保险制度的若干法律问题研究.doc

【摘要】我国现行的铁路旅客意外伤害强制保险制度设立已近60 年, 且鲜有变化。这个在设立之初就存在诸多问题的制度，已经不适应当今社会的发展需求及国际潮流, 亟待完善。本文论述了我国铁路旅客意外伤害强制保险制度相关规定，对其存在的法律问题进行了探讨，提出了完善铁路旅客意外伤害强制保险制度的具体建议。全文共分为四个部分：第一部分简要的介绍了我国铁路旅客意外伤害强制保险的具体规定，包括它的特征、时间、范围、除外责任及实行。第二部分对我国铁路旅客意外伤害强制保险提出分析，论证了该保险现实存在的合理性，并对其与理论和实践相冲突所存在的问题进行深入分析。第三部分是对国外铁路和国内其它交通行业的旅客运输保险的规定介绍。第四部分提出完善我国铁路旅客意外伤害强制保险的建议。增设承运人强制责任险和改革旅客意外伤害自愿险，建立两险相协调的铁路旅客运输保险体系。此外，为了保证受害旅客得到及时救助，由国家设立铁路交通事故救助基金，全面保障旅客的人身权益。更应当从小处做起，完备列车医疗条件和救助条件，及时保障旅客的人身安全。 【英文摘要】Chinas current compulsory insurance system for railway passenger accident injury was established almost 60 years ago with few modifications. The system involved many problems from being articled and therefore, can not adapt to the development of modern society and keep abreast with the internationally recognized practices, and it is high time for it to be improved. This article offers specific suggestion upon analyzing Chinese present insurance system and the relevant legal problems about accident compulsory insurance. There are four parts in total. The first part is a brief introduction to Chinese railway passenger accident compulsory insurance system, including its characteristics, insurance period, insurance scope, implementation and exceptions. The second part is analysis about the compulsory insurance, including the necessity of its existence and also conflicts and problems in the present legal environment. The third part introduces relative systems in the other transportation industry and other countries. The last part proposes improvement suggestions, which are, adding carrier’s compulsory liability insurance, reforming passenger’s accident insurance of both kinds. In addition, building a state relief fund for railway traffic accident for the sake of passengers is necessary.
