论法定夫妻财产制的完善 法学专业学生 蒋梅 指导教师 曾玉珊 摘要：我国法定夫妻财产制由共同法定财产制和个人特有财产制两部分构成,其立法主要体现在婚姻法第十七条和第十八条.由于现行婚姻法相关立法存在缺陷,因而给司法实践中夫妻财产纠纷的解决带来许多困扰,这些缺陷表现在无非常法定财产制立法,夫妻关系存续期间知识产权期待利益的定性不明,婚前财产经过婚后管理和使用的定性不准,一方专用生活用品的界定不清,以及缺少对夫妻个人财产处分权的法定限制制度.针对这些缺陷,并考察国外相关夫妻财产制立法,从共同法定财产制和个人特有财产制这两方面对我国法定夫妻财产制提出几点完善意见,主要包括建立非常法定财产制完善共同法定财产制, 确立知识产权期待利益的夫妻共同财产属性, 运用民法的添附原理对婚前财产的婚后管理和使用重新定性, 一方专用生活物品的界定,夫妻个人财产处分权的法定限制制度. 关键词：法定夫妻财产制；共同法定财产制；个人特有财产制 Comment on perfecting the legal husbands and wives property system Student majoring in Law JIANG Mei Tutor ZENG Yu shan Abstract：Our country legal husbands and wives property system makes two parts of constitutions by common legal property system and individual unique property system, its legislation mainly manifests in marriage law item 17thand 18th.For the present marriage law correlation legislation existence flaw, it brings many puzzles of husbands and wives property dispute in actual judicial practice, these flaws manifests in lacking legislation of extremely legal property system, the qualitative of intellectual property rights anticipation benefit when husbands and wives relationship last is unclear, the qualitative of property held before marriage after management and use in marriage does not permit, the limits of only then special-purpose daily necessities is unclear, lacks of husbands and wives personal property disposition right legal limit system.
