Abstract: Based on the judicial cases of Gong An Bu Records of Legal Cases) , this paper
analyzes the civil judicial procedure of three phases: pretrial, trial and judgment in the Chinese
society in Batavia. The civil judicial system in the Chinese society in Batavia from 1619 to 1928 is
a special historical phenomenon of law transplantation in the immigration society. With autonomous
power, Gongt ang took charge of the civil justice of overseas Chinese. The China. s civil law was
almost transplanted to Batavia. s Chinese society and the civil judicial tradition from China was
sustained there.
