南京师范大学 硕士学位论文 期待可能性理论研究 姓名：潘志刚 申请学位级别：硕士 专业：法学；法律 指导教师：缪蒂生 2009-05-20 摘 要 摘 要 期待可能性理论肇始于德意志帝国最高法院1897年的对“癖马案”的判决， 现成为大陆法系规范责任要素的核心。它的内涵是：在客观异常情形下，行为人 实施了犯罪行为，且行为人亦知道自己的行为是犯罪行为，但依照法不强人所难 的原则，法律不能对其责难。由于我国犯罪论构成体系与大陆法系国家不同，如 何将其适用到我国刑法理论中，成为笔者的关注点。本文通过一个新近案例的争 论，引出期待可能性理论的视角，阐述了期待可能性理论的产生、发展、理论依 据、适用标准等问题，着重探讨了其在我国刑法理论体系中的进路及其适用的标 准问题——将其作为我国犯罪构成的第五要件——我国传统的犯罪构成四大要 件依然是耦合式的，而引进的期待可能性作为第五要件与四大要件形成递进式模 式——以期使得我国的犯罪论构成体系更加科学合理；界定其适用标准，以期使 得期待可能性在实际运用中更具可行性与操作性。 关键词：期待可能性，适法，刑事责任，犯罪 I Abstract Abstract The origin of the theory of expectant probability is the case of a horse it has cacoethes in Reichsgericht in 1897. Now it is the core of the normative responsibility in the civil law system. Its connotation is that under the objective abnormal circumstance, the behavior has been put into effect criminal act and the behavior also knows his behavior is a criminal act but based on the aprinciple of Lex non cogit ad impossibilia ,the law can not blame to the person. Due to the diversity of constitutive elements of a crime between our country and the civil law countries, it turns into the authors attention that how to use the theory into our country corporal punishment theory. In the article the author uses one recently case with issues leading to the angle of expecting possibility theorys , expatiates the theorys arising, developing , theory evidence, standard of applying ,and so on, emphasizly discusses the theorys route and the standard of applying in our country corporal punishment theory system: as
