摘 要
劳务派遣在我国已经成为一种十分活跃的用工形式。作为一种“临时性用
工”,劳务派遣具有雇佣与使用分离的特征。派遣机构雇佣劳动者,与劳动者签
订劳动合同(即派遣契约),然后将劳动者派到要派机构工作,接受要派机构的
指挥管理。派遣机构是派遣劳动者真正的雇主,与派遣劳动者之间是劳动合同关
系。派遣劳动者与要派机构之间仅是指挥监督关系,而派遣机构与要派机构之间
则是商务契约关系。劳动者受雇于派遣机构,却在要派机构处实现了生产力和生
产资料的结合。企业使用劳务派遣,多是出于降低成本,减少责任和灵活用工的
需要。劳动者希望通过劳务派遣找到临时性工作,增加就业机会。
劳务派遣在发达市场经济国家存在了几十年,经历了一个从禁止到严格限制
再到放松管制的过程。作为传统用工形式的补充,劳务派遣有其积极意义,但也
带来一系列问题。希望通过大力发展劳务派遣来解决我国失业问题的观点是错误
的。与发达市场经济国家的劳动力市场背景不同,我国的劳动力市场供大于求,
就业人口多,就业压力大,盲目发展劳务派遣会加剧就业不安定状态,破坏劳动
力市场秩序。我国目前亟待解决的问题是,承认劳务派遣存在的合理性,正视其
社会价值,认识其弊端,尽快完善相关立法,帮助其健康正确地发展。
我国 《劳动合同法》中关于劳务派遣的规定存在着很多不完善的地方。在用
辞定义上,《劳动合同法》的表述不够规范严谨,将劳务派遣称为“劳动者派遣”
更能体现出这种用工形式的特征;在派遣机构的市场准入上,我国规定的门槛过
低。我们可以借鉴德、日、台湾的立法经验,采取“许可证制度”,规范许可证
的审批、续展、拒绝、收回、撤销以及许可证的明示义务,明确主管机关的指导、
监督、检查的责任,并制定一套完备的罚则;《劳动合同法》中规定的劳务派遣
的业务范围是“临时性、辅助性或者替代性”,这种标准不够清晰。在现阶段不
适宜将劳务派遣完全推向市场,应采用列表方式在一定范围内发展劳务派遣业,
随着研究的深入,通过完善立法的方式再逐渐放开业务范围;立法中应增加派遣
机构对派遣劳动者进行职业技能训练的内容,提高劳动者的就业竞争力,保障其

公平就业权;我国立法中规定的派遣契约和要派契约的法定内容不够充分,派遣
劳动者的许多权利得不到有效保障。以立法的方式明确要派契约和派遣契约应具
有的基本内容,使三方法律关系主体的权利义务明确化是十分必
