行业协会在反倾销中的作用及优劣势分析 杨光明 (山东省潍坊市潍坊学院经管系，山东 潍坊 261031) 摘 要：我国目前对外经贸工作中面临的主要问题之一是反倾销问题，我国已经连续9年成为世界反倾销的头号目标国。为了应对反倾销，本文从行业协会的角度分析了行业协会在反倾销中的作用及其优劣势，目的在于希望行业协会在反倾销中能够发挥其应有的积极作用。文章分为两大部分，第一部分分析了行业协会在反倾销中的一般作用，即从对外应诉和申诉以及申请获得“市场经济地位”三个方面作了分析。第二部分分析了行业协会在反倾销中所具有的优劣势，行业协会在反倾销中具有五个优势，既信息优势、成本优势、权威优势、公共关系优势和人才技术优势；同时，行业协会在反倾销中也存在某种劣势，就是在我国现阶段由行业协会出面应诉不利于企业获得分别裁决和单独税率。 关键词：市场经济地位；替代国；单独税率 中图分类号：F752.1 文献标识码：A 文章编号：1811-8755(2004)01091 Analysis of functions and advantages and disadvantages of trade business association in anti-dumping Abstrsct: One of the most important problems to our face in present foreign economic and trade work in our country is anti-dumping, our country has become the first anti-dumping targeted country in continuous nine years in the world. In order to cope with anti-dumping, I analyse the functions and advantages and disadvantages of trade and business association in anti-dumping , aiming at wishing trade and business association would play more positive role in anti-dumping. This thesis can be divided into two parts, the first part is the analysis of general functions of trade and business association in anti-dumping, or dealing with anti-dumping suits from foreign country, filing anti-dumping suit to other country and applying for “market economic country status”. The second part is the advantages and disadvantages of trade and business association in anti-dumping, trade and business association has five advantages: information advantage, cost advantage, authority advantage, public relations advantage , personnel and technology advantage; meanwhile, there is a disadvantage, that is, trade and business association directly dealing with anti-dumping suits from foreign country will lead to lose the opportunity to get separated judgment and individual tax rate.
