摘 要 招投标已经在社会生活的各个方面得到了广泛的应用，在融入到微观个体经济行为的同时，也对国家宏观经济带来了深远的影响，已经成为了一种最具竞争力，最有发展前景的采购方式。在建设工程中，招投标制度的应用有利于提高工程质量，减少工程投资，同时也为建筑市场的繁荣和经济的腾飞做出了巨大贡献。但是由于招投标制度在我国实行的时间尚短，还处于摸索阶段，法律法规及制度都还不完善。这就让一些人有空子可钻，腐败现象时有发生，建设工程招投标的管理亟待加强。 本文分析了政府及标企在招投标过程中的行为及其存在的问题，并提出了相应的改进措施。以及分析了现行招标定标方法及其不足之处，并针对这些不足之处提出了一些改进的建议，接着分析了招投标代理机构在招投标过程中的作用及如何积极推行招投标代理机构制度。 虽然招投标制度在我国建设工程中的应用时日尚浅，不过经过这二十多年的实验与实践，我国也已形成了自己的一套建设工程招投标制度，虽然还不太完善。如果将本文提出的改进措施运用到建设工程招投标的过程当中，相信能对目前的情况有一些改善，对促进我国建设工程招投标活动的规范化运作发挥一定的理论价值及现实意义。 关键字：建设工程；招投标；问题及对策；法律体系； ABSTRACT Bidding has been in every aspect of social life has been applied widely, in into the microscopic individual economic behavior at the same time, also on the national macroscopic economy brought far-reaching influence, has become one of the most competitive, most has the prospects for development mode of procurement.
