立法语言论文：我国立法语言的规范化初探 【中文摘要】法律语言是法律信息传递的重要载体,立法语言是法律语言的一个重要分支,也是法律语言的核心,立法语言的研究和发展对推动我国法治建设有着极其重要的意义。然而,我国长期受“重实体,轻程序”思想的影响,对于立法语言的研究相比欧美国家而言较为滞后,所以本文旨在研究立法语言的规范化,以期为我国立法语言的研究提供参考性建议。本文主要以我国的立法语言为研究对象,以林业规范性法律文件为研究基础,联系当前法律实践,界定立法语言和立法语言标准化的概念,归纳总结立法语言规范化的标准,包括语言风格标准、词语标准和句式标准,对立法语言失范化的现象及原因进行分析,提出我国立法语言规范化的途径。 【英文摘要】The legal language is an important carrier of the legal information delivery. The legislative language is an important branch and core of the legal language. The legislative language plays a significant role in promoting the construction of law in China. However, our country suffers from the thinking of “heavy entity, light procedure”. China still lags behind the Europe and the United States in the study of legislative language. Therefore, the paper studies the standardization of the legislative language and provides some suggestions for Chinese research of legislative language. In this paper, the object of the study is Chinese legislative language. It is based on forestry normative legal documents and contacts the current legal practice. This paper defines the concept of legislative language and the legislative language standardization, and summarizes the legislative language standardization, which includes standards of language styles, words and sentences.
