围标串标现象深度透析及其应对策略 摘要 自我国从2000年开始执行《中华人民共和国招标投标法》以来，建筑市场的竞争逐步走向规范化、法制化、有序化的轨道。然而，近期在建筑市场竞争中不断涌现的串标、围标、合谋等违法行为，已严重干扰正常的市场竞争秩序。围标串标现象不仅使招投标工作改变了其本质和应有的积极意义，而且造成一系列不良社会问题。 本文将分析招投标活动中的不规范行为——围标串标现象的含义、表现形式，分析该行为产生的原因和危害，建立了围标串标的认定指标体系，并提出防范围标串标的策略群和政策建议，目的在于研究如何有效的防止串通招投标行为的发生。在研究过程中，运用了层次分析法、博弈论、SWOT分析、问卷调查等研究工具和方法，针对常见的四类围标串标现象分别提出了具体的应对措施。并在本文最后，归纳了围标串标的防范手册。 本文在对围标串标深入剖析的基础上，提出了一些针对性措施，以求对实践操作具有指导意义，加强有关人员对围标串标现象的重视。 关键词： 招投标 围标串标 应对策略 Depth Analysis of the Phenomenon of Collusion Tender and Its Countermeasures ABSTRACT The competition in construction market has become standardization. Legalization and ordering since The Tendering and Bidding Law of the People’s Republic of China was carried out from 2000 in China. However, collusion and other illegal action have been acted fiercely in construction market recently. As a result, the actions disturb the normal order of market competition seriously. Collusion not only changes the essence of bidding work, but also causes a series of social problem. The paper analyses the Irregularities in bidding activity, including the definition, Manifestations of collusion, the reason and disadvantage of it. And then, it gives a Indicator System of collusion and strategy groups with politic suggestions of collusion. The goal of it is to study how to prevent the collusion. AHP, Game Theory analysis of SWOT and survey was used in the research process. It gives way for four kinds of normal collusion. At last, it gives a conclusion of prevent manual about collusion. The paper gives some steps based on the analysis of collusion, which may make sense for the practice and reminds of the importance of collusion to people.
