AbstractLawyers’rightofgainingevidenceincivillitigationisarighttobeofferedrelevantevidencesuchastestimonyofwitnessesandexhibitsholderspossess(includingdocumentaryevidence,exhibits,audio-visualmaterials,etc.)whenpracticingincivillitigations.Thispapertriestoanalyzethevalueandstatusoftherightofgainingevidenceandexpressesthatlawyers’rightofgainingevidenceisvitalforthecourthousetoidentifythefactsofthecasesoastosafeguardlegitimaterightsofthepartiesandprotectthelawyers’business.However,lawyers’rightofgainingevidenceisincivillitigationworrisome.First,thereisnospecificnormsforgainingevidencelawyerscancomplywith.What’smore,thereisalackofprovisionsofreliefmeans.Sincetherearesomeconflictsintheexistenceoftherightofgainingevidence,itisquiteinfeasibleforlawyerstogainevidenceinjudicialpractices.Alltheseareembodiedinthefactsthatwitnessesarenotwillingtotestifyincourtandthosewhopossessevidencearereluctantinprovidingtheevidencetolawyers.Thispaperattemptstoprobeintothereasonsforthelackoflawyers’rightofgainingevidenceincivillitigation,bearinginmindthatmodeloflitigationtermsofreferenceisoneofthereasonsthataffectlawyers’gainingevidence.Inthebeginningseveralyearsaftertheestablishmentofourcountry,ChinaoncetransplantedthelitigationmodeltermsofreferencefromtheSovietUnion.Althoughitwasaftertransformation,thethoughtstillexists.Inthismodel,Partiesdon’thavetheresponsibilitytoprovideevidence.AstheagenttoParties,lawyersdon’thavetoparticipateininvestigatingevidence,whichmakeslawyers’rightofgainingevidencecannotgetdueattention.Anotherreasonislawyers’status.Becauseofthetraditionalresenttolitigationandlawyers’self-quality,lawyers’statusinourcountryhasalwaysnotbeenpromoted,whichaffecttherightofgainingevidencetosomeextent.Ontheonehand,itdoesn’tgetdueattentioninlegislation;ontheotherhand,itfailstogetduerespectandcooperationinreallitigation.Basedonanalysisonstatusandreasonsoflawyers’rightofgainingevidenceincivillitigation,thispaperbringsforwardsomepersonalviewsonhowtorealizelawyers’rightofgainingevidenceinc
