AbstractAsanimportantpartofcivilprocedurelaw,waiverofclaimssystem,enshriningtheprincipleofdispositioninthecivilaction,highlightingtherightofchoiceofcivilprocedureoftheparties,realizingthedoublevalueoflitigationbenefitsandjurisdictionjustice,isansignificantsysteminthecivilaction.Waiverofclaimsisnotonlythewaytodisposethelitigationrightsoftheparties,butalsoanapproachtoendthelawsuit.Incivillawofcivilprocedure,waiverofclaimsisasystematicregulations,whileinChinasCivilProcedureLaw,it’sonlyalitigationrightsofparties,whichleadstolackofmaneuverabilityinpracticeandgreatlyspoilsitsvalue,lackofcomprehensivesystemtoprotectmakesitisdifficulttoachieveonthelitigantsdispositionaboutwaiverofclaims.Therefore,constructingcivilwaiverofclaimssystemisnotonlyneedslegislationsperfection,butalsoneedsproperpracticaloperation.Tothisend,thisarticlestartsfromthedefinitionoftheconceptandnatureofwaiverofclaims,throughthecomparativeanalysisoftherepresentativeofthewaiverofclaimssystemsincivillaw,analyzesthedefectswithinwaiverofclaimssystemonourlegislationsandlegalpractice,onthebasisoftheextraterritorialprovisionsofthesystem,comprehensivejudicialliveconceivesthewaiverofclaimssystem.Thewholearticleisdividedtofivechapters.Thefirstchapteristhedefinitionofwaiverofclaims.Therehasdifferentconceptsandpropertiesdefinedaboutwaiverofclaimsincivillawcivilactiontheorists,andthischapterfrommanydifferentpointsofviewtodeterminewhichbestmeetsthedoctrineofwaiverofclaimsbehavior.Inaccordancewiththebehaviorandcontentofwaiverofclaims,it’sintroducedtheclassificationofthewaiverofclaimsandcomparedthedefinitionwiththerelatedconceptsThesecondchapterisdiscussesthelegalsignificanceofwaiverofclaims,whichhighlightstheindependentstatusandirreplaceablevalueaboutwaiverofclaimsincivilaction.Theauthortrytomaketheoveralloutlineofwaiverofclaimsfromthemacroscopicangletolaythetheoreticalfoundationforlaterexpansioninthefirsttwochaptersinthisarticle.Thethirdchapterisintroducesthewaiverofclaimssysteminmaincivillawcountriesandregions.Therehav
