ANALYSIS OF MALICIOUS NEGATIVE EVALUATION ON LINESHOPPING TO INCRIMINATE—ON THE COUNTRYS FIRST CASE OF MALICIOUSNEGATIVEEVALUATORSABSTRACTWith the widely spreading of internet technology，the electronic commerce of our country grows vigorously，and the number of online shopping has reachedan unprecedented scale of the second ranked in the world. Online shopping brings convenience to our life，but it also becomes a breeding ground for a variety of negative phenomena，and negative evaluation was born. Currently negative evaluation intensifies， and even spawned a job for groups of negative evaluators，which violates the legitimate rights of the vast network sellers，and disturbs the order of the network shopping. However，the existing civil and administrative means to curb the effect is not explicit， whether to start criminal law regulation becomes a serious problem. On July 3，2013，“Hangzhounegative evaluators case” sentenced. The negative evaluators were determined to crime of extortion. This is the countrys first incriminated case of negativeevaluation，which caused much controversy. The dispute mainly focus on thebehavior of negative evaluation into the crime problem.Therefore， this article takes malicious negative evaluation as the research object，and hopes to solve the incrimination problem of negative evaluation. Themain content of this paper will introduce from the four following parts: Firstly，this paper introduces a case，puts forward the focus of controversythrough the analysis of the first case，and finally leads to the subject of thispaper.The second chapter summarizes the current malicious negative evaluation in our online shopping. First of all，it explains negative evaluation of online shopping，describes the definition and characteristics of malicious negative evaluation，and further analyzes the main behavior patterns .The third chapter discusses the incrimination basis of negative evaluation to find a legitimate reason from four theoretical perspectives.Th
