我国排污权交易立法问题分析-analysis on legislation of emission rights trading in china

出我国应尽快通过《排污许可证管理条例》，为排污权交易提供法律基础和依据，最后提出要由国务院制定《排污权交易管理条例》，具体规定排污权交易的主体与客体、交易合同、交易程序、交易中介机构、法律责任与救济措施等款项，为全面开展排污权交易提供直接有效的法律依据和操作规则。第五部分是本篇论文的结论。我国排污权交易从制度层面到实践层面也不过短短二十年时间，其在实践中遇到许多障碍是在所难免的。我国应当吸取国内的历史教训和国外的先进经验，立足实际，构建和完善我国的排污权交易法律体系，从法律上明确该制度并制定具体的实施细则。关键词：排污权；排污权交易；立法；研究AbstractResourcesandenvironmentalproblemshavealwaysbeenaccompaniedbysocio-economicdevelopment.Economicdevelopmentandenvironmentalpollutionseemstobeapairoftwinbrothers.Environmentnotonlyoffersmaterialconditionsandspaceforhumanbeings，butalsomustbearavarietyofpollutantsproducedbyhumanactivities.Environmentalpollutionproblemsneedtobesolvedurgentlyintheprocessofmoderneconomicdevelopment.WiththegradualmaturityofChinesemarketeconomicsystem,experienceinresourceallocationbecomesmoreandmorematurethroughmarketmeans.Emissiontradingsystemisthetypicalwaytosolveenvironmentalproblemsthrougheconomicmeans.Emissiontradingsystemnotonlystimulatesenterprisestoimproveproductiontechnologyandreducetheemissionlevelsofpollutants,butalsoithelpstomaintainandimproveenvironmentalconditions,whichachievebotheconomicandenvironmentalbenefits.Thisthesisiswrittenbymethodsofconceptexplanation,logicalreasoningandcomparativeanalysis.Itmakesfurtherstudyintoarangeofissuesrelatedtoemissiontrading,whichfocusontheemissiontradinglegislation.ItishopedthatitmaybehelpfultoestablishasoundlegalsystemofemissiontradinginChina.Thisthesisisdividedintothefollowingfiveparts.Thefirstpartofthisessaydescribesthebasictheoreticalissuesrelatedtoemissiontrading.Itintroducestheconceptandnatureoftheemissionrights,theconceptsandfeaturesofemissiontrading,andTheoryofExternal,theCoaseTheoremandothertheoreticalbasesthatrelatedtoemissiontrading.Finally,itindicatesthesuperiorityofemissiontradingbycomparingwithotherenvironmentalprotectionmeans.ThesecondpartofthisthesisintroducesthepracticalexperienceandlegislationofemissiontradinginAmerican.TheUnitedStatesisthebirthplaceoftheemissiontradingsystemanditgraduallyestablishesitsownlegalsystemofemissiontrading.Andthusbecomeb
