1 论文编号： 中国政法大学 本科生毕业论文 南海断续线的法律地位 南海断续线的法律地位 [摘要] 2013年11月32日中国政府宣布划设东海防空识别区,并称将来中国会在“适当的时当宣布划设类似的防空识别区,可能涵盖南海。中国是否有权在南海划定防空识别区,首先要明确的是中国对南海的合法主权。关于南海断续线,周边国家和美国提出了质疑。在学术界对断续线的性质也有诸多不同的说法，主要有4种主张：国界线说、历史水域说、历史权利说、岛屿归属说。 本文主要采取文献研究法，通过各种专业数据库和中外国际公法方面的著作查找相关资料，通过借鉴各种传统理论和相关研究成果来论证断续线的性质，本文主要分析4种学说的相同与不同之处从历史角度和法律角度来论证断续线的性质，本文比较支持岛屿归属的说法。 [关键词] 南海 断续线 法律地位 The Application of Law Rules in Foreign-related Tourism Infringements [Abstract] The government of China declared on November 23th in 2013 that the air defense identification zone in the East Sea was established, and the similar air defense identification zones which perhaps cover the South China Sea will be established in a proper time. Clarifying China’s legitimate sovereignties to South China Sea is the premise of determining whether China is entitled to establish the air defense identification zone in the South Sea. Surrounding countries and America put forward some disagreements about the dotted line in the South Sea. And some scholars come up with some different theories about the legal status of the dotted line in the South Sea, such as national boundary theory, historical waters theory, historical rights theory and island’s ownership theory. To clarify the legal status of the South Sea dotted line, the author searches quantities of relevant information from professional date bases, treatises on international law and relevant research achievements. Then the author analyzes four traditional theories by comparing their similarities and differences and demonstrates the status of the South Sea dotted line from historical perspective and legal perspective. In the conclusion, the author is in favor of the island’s ownership theory.
