摘 要刑事宣判制度是我国刑事诉讼中的一项重要制度，而其中的当庭宣判问题 又是宣判制度中的一个重要内容。随着司法制度的不断完善，我国各级法院逐 渐追求高标准的当庭宣判率，确实取得了一定提高，然而，在这些提高的背后 却存在着诸多弊端，很大程度地损害了我国司法审判的公正性，当庭宣判实现 不了其应有的价值。为了实现刑事当庭宣判制度的真正价值，我们有必要在借 鉴他国成功经验的基础上结合我国的实际情况，对我国刑事当庭宣判制度做出 比较完善的改革，解决刑事当庭宣判制度中存在的问题。作者通过对刑事当庭宣判制度的理论和价值分析，结合各国实践与我国现 状，寻求解决我国刑事当庭宣判困境的道路。首先，作者主要是从刑事当庭宣判制度的概念上进行理论分析。对刑事当 庭宣判制度的涵义、价值、意义以及其所贯彻的理论基础概括研究，对刑事宣 判的两种宣判方式进行比较研究，对比两者的异同和优劣而分析刑事当庭宣判 的重要性。其次，主要是从对我国刑事当庭宣判制度发展历程的简要分析入手，对两 大法系刑事当庭宣判制度的实行状况进行深入研究。通过对古今中外刑事当庭 宣判制度的比较，从原因、背景等方面分析，阐述实行刑事当庭宣判制度的优 点及理由。再次，则是对我国刑事当庭宣判制度的现状以及成因进行分析。从我国目 前刑事当庭宣判制度在司法实践中所存在的一系列问题中探究相应的原因，了 解相关制度的缺失情况，以便有针对性地提出对策。最后，针对上述章节分析的原因对我国刑事当庭宣判制度提出相应的完善 建议。主要从立法方面、庭审主义模式、审判委员会制度、定罪量刑分离制度 等几个方面的改革来着手解决，以期通过这些措施的实施来解决我国刑事当庭 宣判制度运行过程中存在的困难。关键词：刑事当庭宣判集中审理直接言词诉讼及时 审判统一AbstractCriminal sentencing system is an important system of china’s criminal proceedings, and court sentencing issues among which become an important part in sentencing system. In order to realize the real value of criminal court sentencing system, it is necessary for us to learn from successful experiences in other countries, and make more complete innovations based on the actual situation in our country.
