AbstractApril3,1999,ChongqingCity,theFirstIntermediateCourtchangedthepublicprosecutor’schargesinherrulestothecaseof“Qijiangrainbowbridgecollapse“.CanajudgechangethePublicprosecutor’schargescausedwidespreadcontroversyintheacademicworld,andbothofsideshadresortedtotheDueProcess.TheCounter-sideattackedthattheCourt’swayviolatedtheDueProcessonthegroundoftheprinciplethat“Allegationsoughttoseparatefromtrial“and“neutraljudge”etc..WhatisDueProcess,however,andwhatisitscriteria?Itneedsmorein-depthexploration.FollowingthehistoryofDueProcessthattheDueProcesscameintobeingintheUnitedKingdom,developed,setoffaclimaxintheUnitedStates,generallybeadoptedworldwideinthistimes,wecanseethatDueProcesswasgeneratedintheUnitedKingdomforitsownuniquepolitical,economic,cultural,religiousandotherfactorsoftheitstimes.TheconceptorsystemofDueProcesshasbeingdeveloping,changing,andeachdevelopment,changesoftheDueProcessreflectsthebalanceandconflicofitsdifferentvalue.CriteriaforjudgingthelegitimacyofDueProcessisthecoreissueoftheDueProcesstheory.Thereweremanytheoriesonit，buteveryoneofthesetheorieshasitsdrawbacksbecauseofthat“legitimacy”isavaluejudgmentandisboundtoleadtocontrovert,sononecanbeinsurmountable.TothecriteriaforjudgingthelegitimacyofDueProcess,itshouldbe“Insistonthebalanceofvalueandopposetheone-sided”,“Insistonfreelydiscretionofjudges,opposethestatutorystandard.”ThetheoriesofTheValueBalancehasitssupportfromphilosophyandThePrincipleofProportionalityoftheadministrativelaw,especiallyfromjudicialpracticeofBritainandtheUnitedStates.Thejudgeshouldevaluatetheevidencefreelyontheissueofprocess,judgingallvaluescomprehensivelyandtaking“confidentceinheart”asthestandardofproofsoastogetmoreaccuratesolutionontheissueofwetheraprocessisdueprocessornot..TheDueProcessisinitsdevelopingsowhetheraaprocessthasitslegitimatlyandwetherajudgecanchangethepublicprosecutor’schargesshouldbelongtojudge’sduty.Thereforeantagonist’sso-calledallegationsthatjudgechangethepublicprosecutor’schargesviolatestheDueProcesslackspersuation.
