平顶山学院经济与管理学院 经济法论文 论消费者权益保护的实现途径 专 业: 会 计 学 班 级: 三 班 二○一一年十二月 摘 要 随着社会经济的发展和收入水平的提高，消费需求增长，法制观念深入人心，消费者保护工作亦越来越受到世界各国的重视。从世界各国的消费者权益保护立法来看，保护消费者合法权益只不过是保护消费者法律体系的初级目标，以保护消费者权益来维护市场交易的正常秩序、市场经济的健康发展和社会的稳定才是消费者权益保护法律体系的终极目标和价值所在。所以保护消费者权益途径的利弊，应当以是否有利于消费者权益的保护、是否有益于市场经济的发展、是否有利于社会的稳定为判断标准。为了更好的使消费者权益争议能够得到切实有效的解决，我国《消费者权益保护法》设定了协商和解、调解、申诉、仲裁、诉讼五种渠道途径。在现实生活中，消费者可根据所遇到情况不同的纠纷，进行选择适用。虽然这几种途径最终的目标是一样的，但是在实践生活中，如果选择不同的途径产生的效果也就会有差别。这不但影响了对消费者合法权益的保护，而且也影响了法律价值的实现。本文通过对我国现有解决消费者权益纠纷的五种途径进行多层次多方面剖析、比较，提出如何维护消费者合法权益的合理方案，并在此基础上提出对我国建立和完善消费者权益保护法律制度的一些合理建议。 [关键词]? 消费者权益? 消费者权益纠纷?消费者权益诉讼 With the development of social economy and the improvement of income level, consumer demand growth, the concept of legal system and thorough popular feeling, consumer protection work also more and more get the attention of the countries all over the world. From the countries of the world consumer protection legislation to see, to protect consumers legal rights is just to protect consumers legal system of primary goal, to protect consumers rights to maintain the normal order of market trade, the healthy development of the market economy and social stability is the protection of consumers rights and the ultimate goal of legal system and value.
