The European Commission is carrying out a study to assess the impact of various options for ways to strengthen the rights in criminal proceedings of suspects or accused persons to be presumed innocent.. A linked objective, along with other measures included in the Roadmap for strengthening procedural rights of suspected or accused persons in criminal proceedings, is that Member States will have confidence that their citizens who find themselves involved in criminal proceedings in another Member State will be treated on the basis of common EU minimum standards, and consequently they will have The aim of this questionnaire is to obtain an understanding of the situation in all Member States and identify relevant domestic case law or jurisprudence relevant to the presumption of innocence. It also seeks to gather concrete examples of where issues arise in domestic law, in practice and in cross-border cases. Finally, it is the opportunity for stakeholders to share their views on a possible EU measure on the presumption of innocence and the form it should take.
