§381.3 行政管理（Administration）　　??§Administration. 　　??(a)[Reserved] 　　??(b)TheAdministratormayinspecificclassesofcaseswaiveforlimitedperiodsanyprovisionsoftheregulationsinordertopermitappropriateandnecessaryactionintheeventofapublichealthemergencyortopermitexperimentationsothatnewprocedures,equipment,andprocessingtechniquesmaybetestedtofacilitatedefiniteimprovements:Provided,ThatsuchwaiversoftheprovisionsoftheregulationsarenotinconflictwiththepurposesorprovisionsoftheAct. 　　??(c)Pursuanttosection6oftheAct,theAdministratorbelievesthat,inestablishmentsprocessingpoultryproductsatwhichinspectionundertheActandregulationsisrequired,thefrequencywithwhichandthemannerinwhichpoultryproductsmadefrompoultrypreviouslyslaughteredandevisceratedinofficialestablishmentsarereinspectedbyInspectionServiceemployeesshouldbebasedonconsiderationsrelevanttoeffectiveregulationofpoultryproductsandprotectionofthehealthandwelfareofconsumers.Inordertotestproceduresforuseinmakingsuchdeterminationsand,inparticular,fordeterminingwhetherand,ifso,towhatextenttheintensityofinspectioncoverageexceedsthatwhichshouldbedeemednecessarypursuanttosection6oftheAct,theAdministratorisinitiatingexperimentationofanewsystemofinspectionforreviewingtheperformanceofestablishmentsandfordesigningthesupervisionandotherconditionsandmethodsofinspectioncoverage.Fortheperiodofsuchexperimentation,theAdministratorshallidentifyestablishmentsforreview,andthefrequencyandthemannerofinspectionbyInspectionServiceemployeesshallbedeterminedonthebasisoftheresultsofthosereviewsandbeotherwiseinaccordancewiththissection. 　　??(d)Thedeterminationsreferredtoinparagraph(c)ofthissectionshallbemadebytheInspectionServiceandshallreflectevaluationsoftheperformanceandthecharacteristicsofsuchestablishments. 　　??(1)Inassessingtheperformanceofanestablishment,thefollowingfactorsareappropriateforconsideration: 　　??(i)Thehistoryofcompliancewithapplicableregulatoryrequirementsbythepersonoperatingsuchestablishmentorbyanyoneresponsiblyconnectedwiththebusines
