中华人民共和国商标法实施细则Implementing Rules of the Trademark Law of the PRC　第一条根据《中华人民共和国商标法》（以下简称《商标法》）第四十二条规定，制定本实施细则。　Article 1 These Rules are formulated in accordance with the provisions of Article 42 of the Trademark Law of the Peoples Republic of China (hereinafter referred to as the Trademark Law).　第二条商标注册申请人，必须是依法成立的企业、事业单位、社会团体、个体工商户、个人合伙以及符合《商标法》第九条规定的外国人或者外国企业。　Article 2 Applicants for trademark registration must be enterprises, institutions, social organizations, individual industrialists or businessmen or partnerships of individuals that are formed in accordance with the law, or foreign nationals or foreign enterprises that conform to the provisions of Article 9 of the Trademark Law.　本实施细则有关商品商标的规定，适用于服务商标。　The provisions of these Rules about trademarks of goods are applicable to trademarks of services.　第三条申请商标注册、转让注册、续展注册、变更注册人名义或者地址、补发《商标注册证》等有关事项，申请人可以委托国家工商行政管理局认可的商标代理组织代理，也可以直接办理。　Article 3 In applying for trademark registration, registration of assignments, registration of renewals, the change of name or address of a registrant, the replacement of a Trademark Registration Certificate or other related matters, the applicants may entrust a trademark agency authorized by the State Administration for Industry and Commerce to represent them, and may also perform the application formalities directly by themselves.　外国人或者外国企业在中国申请商标注册或者办理其他商标事宜，应当委托国家工商行政管理局指定的商标代理组织代理。　When foreign nationals or foreign enterprises wish to apply in China for trademark registration and the handling of other trademark matters, they shall entrust a trademark agency appointed by the State Administration for Industry and Commerce to represent them.　商标国际注册，依照《商标国际注册马德里协定》办理。　The international registration of trademarks shall be done in accordance with the Madrid Agreement for International Registration of Trademarks.　第四条申请商标注册、转让注册、续展注册、变更、补证、评审及其他有关事项，必须按照规定缴纳费用。　Article 4 Applicants for trademark registration, registration of assignments, registration of renewals, the change of name or
