论行业协会限制竞争行为的竞争法规制 （硕士论文摘要） 行业协会的发展是市场经济发展的必然要求。但是，对于市场经济的发展而言，它又是一柄“双刃剑”。一方面，行业协会为了维护本行业的公共利益以及促进本行业健康发展，可以通过加强行业自律，引导行业协会成员依法竞争，维护市场公平的竞争秩序；另一方面，行业协会同样可能为了行业协会成员利益的最大化而对市场竞争施加限制性影响。我国2008年8月1日开始实施的《反垄断法》明确规定，禁止行业协会实施限制竞争行为。但是，这对于规制行业协会的限制竞争行为而言只是一个起步。“空洞”的法条在更多意义上起着宣示的作用，我国对行业协会限制竞争行为的规制还是处在一个亟待完善的阶段。在这种特殊的背景下，有必要对行业协会限制竞争行为的规制进行深入的研究，促进完善对行业协会限制竞争行为的规制。 本文对“行业协会限制竞争行为的竞争法规制”的研究主要分成五个部分，共三万余字。 第一部分为引论。概述本文选题的背景及意义、国内研究现状及本文的研究方法，为下文的论述作好铺垫。 第二部分是对行业协会的限制竞争行为进行具体的分析。包括三个方面的内容：对相关概念的界定，行业协会限制竞争行为的主要表现形式以及竞争法对行业协会限制竞争行为规制的价值。通过该部分的论述，对行业协会的限制竞争行为形成一个全面、准确的认识，肯定规制行业协会限制竞争行为的必要性。 第三部分主要分析竞争法对行业协会限制竞争行为的规制。具体从三个方面展开：竞争法对行业协会限制竞争行为的主体资格的认定；竞争法对行业协会限制竞争行为的违法性的判定标准；竞争法对行业协会限制竞争行为法律责任的设置。该部分的主要目的在于说明竞争法对行业协会限制竞争行为规制的具体方式与措施。 第四部分论述我国对行业协会限制竞争行为规制的现状及其完善途径。在分析现有法律、法规，总结存在的问题的基础上，就完善我国对行业协会限制竞争行为的规制提出几点建议。具体建议包括四个方面：规制行业协会信息交流行为，消除行政指导下的行业协会限制竞争行为，完善行业协会限制竞争行为的行政责任，设置行业协会限制竞争行为的民事责任。 第五部分为结语。阐述笔者在本文写作过程中对该问题的总体认识及感受。 [关键词] 行业协会 限制竞争行为 竞争法 规制　 On Competition Law’s Regulation of Associations’ Competition-limited Activities Abstract Major: Juris Master Research area: Economic Law Author: Luo Gui Tutor: Professor Xu Shiying The rising of association is inevitable in market economy environment and it’s also a double-edged sword for the development of market economy.
