PAGE 1论交通强制保险的“无盈无亏”原则（硕士论文摘要）在最新的社会保险法草案出台之前，交通强制保险一直是保险领域内关注度最高的“明星险种”。作为与广大群众日常生活最密切相关的强制保险险种，交强险一直处于风口浪尖，非议争论不断。所有的问题最后几乎都能归结到保费与保险金额之间的平衡问题，作为交强险特有的“无盈无亏”原则，承担了解决该问题的重担，研究意义不言而明。本文运用了经典法理学和民法学理论，以及从法律经济学视角，对交通强制保险的“无盈无亏”原则作了详尽的论述，本文的分析进路更侧重于规范的实践层面。文章共分为四个部分。第一部分介绍了“无盈无亏”原则的基本概念及法理基础，从交强险的强制性、政策性和公益性三方面入手对“无盈无亏”原则的必然性进行阐述。第二部分在前一部分的基础上，深入论述了“无盈无亏”原则的实质内涵，即基本保障、最低保费及整体无盈亏，并通过该原则实质内涵，反向对交强险部分理论争议提出笔者的观点。第三部分详细阐述了交强险实际运营及“无盈无亏”原则贯彻情况，并分析其中弊病，运用法律经济学的方法，从涉及交强险的三方主体——保监会、保险公司、投保人三角度分析弊病产生的原因。第四部分通过比较与我国交强险立法类似的日本汽车强制保险运营情况，提出笔者对现行交强险如何更好地贯彻“无盈无亏”原则提出建议，并希望从观念上对理解该原则进行革新。“无盈无亏”作为交强险非常重要原则，没有受到学界足够的重视，交强险专著论及该原则的笔墨往往限于一个章节，系统的论文则完全没有。笔者认为，该原则实际上是贯通整个交强险的轴心，系统论述该原则，有利于对交强险立法理念的理解，对交强险的有效运行有着重要作用。[关键词] 交强险 “无盈无亏”原则 实证分析The Study of “No profit and no loss” principle in the compulsory insurance（Abstract）Major: Economic LawResearch direction：Commercial LawAuthor：Director：The compulsory insurance for traffic accident was focused as a “Star insurance” in the insurance field until the latest Social Insurance Law was promulgated.
