论钓鱼岛在中日东海划界中的效力 作者姓名：乔方华 作者学院：大连海事大学法学院 [摘要] 钓鱼岛问题一直是个复杂的国家领土争端问题，牵涉到多个领域方面的知识架构，涵盖国际法、海事立法管理、以及国际经济政治形势政策等内容。所以说钓鱼岛问题的解决是一个艰难的过程，需要中日两国共同努力，充分发挥双方各自的智慧，找到一个能最大限度的照顾双方本国利益的同时，公平、公正的处理相关争议问题的方法，给两国人民百姓造福祉，谋福利。本文重点从国际法领域中的“岛屿在海洋划界中的效力作用问题”角度对钓鱼岛相关问题进行分析和探讨，用法理原理和国际法基础理论知识解读各个细节和具体问题，从而对钓鱼岛相关问题在法律角度有深入的了解。 [关键词] 岛屿； 划界效力；争端解决 引言：　钓鱼岛又称钓鱼台、钓鱼台群岛、钓鱼台列岛（日本称其为“尖阁列岛”），位于中国东海大陆架的东部边缘，在地质结构上是附属于台湾的大陆性岛屿。钓鱼岛列岛由钓鱼岛、黄尾屿、赤尾屿、南小岛、北小岛和3块小岛礁即大北小岛、大南小岛、飞濑岛等8个无人岛礁组成，分散于北纬25°40′～26°、东经123°～124°34′之间，总面积约6.344平方公里。这些岛屿在地质上和花瓶屿、棉花屿、彭佳屿一起，都是台湾北部近海的观音山、大屯山等海岸山脉延伸入海后的突出部分，为台湾岛的附属岛屿。钓鱼列岛周围海域面积约为17万平方公里，相当于5个台湾本岛面积。钓鱼岛隶属于中国台湾省宜兰县头城镇大溪里管辖。1972年5月15日，美国将琉球主权移交日本时，一并将钓鱼台列屿的行政管辖权也交给日本。目前该岛实际由日本控制，被划为冲绳县石垣市，日文名称“鱼钓岛”；针对日本的行径，中国大陆及台湾对钓鱼台列岛声张主权， 自1970年代开始，华人组织的民间团体曾多次登岛或试图登岛以具体行动宣示主权，称为“保钓运动”。1]International Court of Justice Reports,1969.
