安徽财经大学硕士学位论文 “地沟油”监管法律制度研究 内容摘要 近年来，我国“地沟油”案件频发，食用油安全形势异常严峻。随着 小商小贩到中小企业、大型企业甚至国内知名企业“地沟油”违法事件的 连续曝光，我国食用油安全问题已经成为广大人民群众日益关切的热点问 题。如何监管好“地沟油”，防止其流向餐桌，保障食用油质量安全和城 乡居民的生命健康权免受不法侵害，是一个关系国计民生且亟待解决的重 要问题。 本论文从法律的角度，力图通过对我国“地沟油”监管法律制度的研 究，建立健全我国“地沟油”监管法律制度体系。 本文分为四个部分： 第一部分，通过对近期我国频发的食用油事件的回顾，概括了本文的 研究思路和结构安排，并指出了本文的研究意义。 第二部分，然后，在分析“地沟油”监管法律制度研究的必要性的基 础上，通过对我国“地沟油”监管法律制度现状的分析、研究，剖析我国 “地沟油”监管法律制度存在问题及其成因。 第三部分，介绍、分析了部分发达国家监管“地沟油”法律制度，从 中总结出我国建立、健全“地沟油”监管法律制度值得借鉴的成果经验。 第四部分，在借鉴发达国家先进经验和技术基础上，探讨突破当前“地 沟油”监管“瓶颈”的方法，努力构建保障食用油安全的法律监管模式， 建立健全我国“地沟油”监管法律制度体系。 关键词：食用油，地沟油，食用油安全 “地沟油”监管法律制度研究 ABSTRACT LEGAL CONTROL SYSTEM OF ILLEGAL COOKING OIL ABSTRACT In recent years, cases of illegal cooking oil have occurred frequently, and edible oil safety situation has become extremely severe. With successive exposure of illegal cooking oil cases of vendors, small, medium-sized, large and even some domestic well-known enterprises, the safety issue of edible oil has become a growing concern of the broad masses of people in China. How to deal with illegal cooking oil and prevent it from flowing to dining-table so as to guarantee safety of edible oil and the rights for life and safety of urban and rural residents has become a burning problem. From the legal perspective, this thesis bases its research on the study of legal control system of illegal cooking oil and discusses how to construct and perfect the legal control system of illegal cooking oil in China. The thesis consists of the four following parts. The first part reviews the safety issues concerning edible oil in recent years, talks about the research route and structure of the thesis, and then highlights the significance of this research. The second part starts from analysis of necessity of research on legal control system of illegal cooking oil and then through analysis and research of the present situation of legal control system of illegal cooking oil, this part deals with the problems and causes of the existing legal control syste
