摘 要 随着中国产品越来越多地走向世界，与贸易相关的摩擦也随之增多，尤其 中国企业高科技产品在试图打进美国等发达国家市场时，往往遭到该国竞争对手 运用 337 调查、专利诉讼等反制手段，试图将中国对手或逐出该国市场，或者榨 取数额巨大的罚款，以维护其固有利益。这种专利相关的风险呈愈演愈烈之势， 成为中国企业进军发达国家市场必须考虑并采取有效应对措施的关键性风险。 在中国，专利预警在走出去企业遭遇到的惨痛教训后而逐步发展起来，相 关的研究也随之展开。高校等机构的研究者通过引入各种专利指标并赋予一定权 重，再建立起各种模型，希望能量化评估专利风险；专利中介则在企业具体问题 而委托下，通过了解企业的产品技术、运用专门数据库检索、专利比对等开展某 个产品或产业的预警研究。两种方法各有侧重点。 本文采用后一种方法研究一个具体企业的产品准备打进美国市场前开展的 海外专利预警项目。相关企业要准确评估专利方面面临的风险，可首先采用行之 有 效 的 方 法 对 所 处 的 行 业 的 风 险 做 出 全 面 、 准 确 的 评 估 ， 这 里 采 用 了 PESTLE+SWOT 分析方法评估案例分析对象所处氟橡胶行业的风险，得到该行业处 于有利的发展阶段，在国内外市场均大有可为的结论，再在此基础上展开该转制 院所某个新产品拟出口美国所可能遇到的专利侵权风险分析，包括采用合适的数 据库，采用准确的检索式，对检索到的大量专利数据予以清洗，分析得出行业发 展趋势，全面分析竞争对手的专利布局及发展态势，对可能涉及的侵权专利重点 剖析，确定是否侵权，从而确定未来涉及的专利诉讼风险及我方胜诉的可能性。 在全面分析、准确认识专利侵权风险的基础上确定应对的策略。 本文在分析具体案例的基础上，结合工作实践，最后在企业专利管理风险切 入点、与专利中介机构合作、企业专利数据库选择等方面提出了自己的建议。 关键词：跨国经营 专利风险 预警 管理策略 ABSTRACT The Chinese companies who want to sell the high technical products to developed counties such as USA often encounter attacks from rivals, including 337 investigations, patent lawsuit and other patent barriers. The rivals try to expel the Chinese companies or declare large amounts of punitive damage to ensure their old interest. So involved patents risks and relevant response become critical to the Chinese new enterers. Patent freedom to operate (FTO) has developed after the domestic companies encounter big losses when they want to enter the developed markets and followed the relevant studies. Researchers from universities try to introduce varies patent indicators and offer some certain weight, then get a quantitative patent risk value by modeling. The IP consultant companies focus on understand the technology/products/process of client firstly, then apply specialized database and try to find the possible infringed patent or patents, and then analysis the situation to offer an appropriate legal opinions. Each method has its own concerned field. The latter research was applied in the article for a FTO for a specific product of a domestic company aiming at
