PAGE PAGE 2 界经济中的地位、最终实现区域内贸易自由化，离不开其竞争政策及法律的制定。本文 通过对北美自由贸易区的竞争政策及法律的研究，力求为构建中国——东盟自由贸易区 竞争政策及法律提供符合其自身特点的模式。 通过对北美自由贸易区竞争政策及法律进行比较深入、全面地研究分析，笔者提 出了以下个人观点：（1）欧盟的竞争竞争政策及法律的合作方式不适合中国－东盟自由 贸易区的实际情况，不宜被采纳；（2）北美自由贸易区竞争政策及法律比较适合中国— —东盟自由贸易区的特点，可资借鉴；（3）归纳出北美自由贸易区竞争政策及法律的规 则及其内容的主要特征；（4）构建了中国——东盟自由贸易区竞争政策及法律的框架性 内容。 关键词： 北美自由贸易区 竞争政策 法律 反垄断法 Abstract The competition policy and law of North America Free Trade Area is mainly reflected among the regulations of chapter 15 of North America Free Trade area Agreement (NAFTA ), which is the result of coordination of the competition policies and law of three members of North America Free Trade Area. And it is different from the competition policy and law of European Union. According to the principle of “treaty must be abided by”in international law, its members must abide by the competition policy and law of North America Free Trade Area, namely every member cant deviate from the agreement while making and implementing its domestic competition policy. The competition policy and law of North America Free Trade Area can contribute to elimilating the individual barrier produced by the individual conduct of limiting competition and the new trade barrier caused by its members’carrying out different competion policies at home ,which promotes the unity of its member’s competition policy under international law and the development of liberalization of trade in the district. Economy globalization and integration of regional economy are two great development trends in current world economy, and every country have closer connections in its economy.Any country cant break away from the track of development of the world economy to develop itself isolately.
