内容摘要 新刑法聚众斗殴罪 （以下简称“本罪”）的设立对打击和预防妨害社会管理 秩序犯罪发挥了重要作用。但司法实践就本罪的转化存有不少争议，如转化主体 范围、具体罪名的确定以及罪数形态等问题一直未形成共识。文章开篇通过举示 研讨案例归纳提出聚众斗殴罪在转化定罪中存在的主要问题。第二部分就聚众斗 殴罪的基本犯罪构成进行了简要分析，紧接着在第三部分从转化犯的概念特征入 手，对聚众斗殴转化定罪的原因、转化的条件、转化原则等相关理论问题进行了 梳理。提出因主客观要件的变化引起基本罪质向转化罪质的发展变化是聚众斗殴 转化定罪的原因，行为具备转化罪所需的全部构成要件是转化的必要条件。同时 还提出，转化定罪应按照共同犯罪理论来确定转化的主体范围，遵循主客观一致 原则确定具体罪名。文章在第四部分重点对聚众斗殴转化定罪的具体形态进行了 论述。就转化主体范围分列了6 种具体情形，就转化罪名及罪数形态也分别情况 进行了归纳梳理。 关键词：聚众斗殴；转化；形态 Abstract The crime of brawling, which was stipulated in the Criminal Law of the PRC (1997), has played an important role in the cracking down and prevention of disruption of orders of social administration. However, there has been a lot disputes over the transformation of this crime in practice, such as the confines of subjects within which the transformation can be applied, the ultimate accusation, and the quantity of crimes. This dissertation would initially sum up the main problems in accusation through induction of the trial cases. And then after a brief analysis of the constitution of this crime, the author ， by summarizing related theoretical problems in the causes, conditions, and principles dealing with transformed crimes ，puts forward that it is the subjective and objective elements that are the prerequisite for the primary crime to convert. Also, it is in the author’s view that the convertible confines of subjects shall be based on the joint crime theory and the ultimate accusation must be limited to the correspondence between subjectivity and objectivity. In the last part is the thorough discussion on the convertible subjects, the accusation, and the quantity of crimes under specific circumstances. Key words: brawling
