浅述建设工程施工索赔 　　【摘 要】针对施工企业在施工项目管理过程中出现的误区，探析施工企业索赔的基本原则。从工程项目管理的角度，说明了如何做好施工索赔和施工企业索赔的具体操作步骤，指出处理好施工索赔是施工企业保障自我利益的重要手段。 　　在工程项目管理中，施工索赔是一项复杂的经营管理工作。当今国内工程项目承包市场竞争日趋激烈，低价中标已成为规律性的操作方式，施工索赔对于承包商经营目标的实现非常重要。对索赔的意义和概念进行了阐述，对当今国内施工项目索赔管理中存在的问题进行了分析，并提出了相应的对策和建议。 　　【关键词】施工索赔；索赔程序；索赔依据；索赔管理 　　Construction engineering construction claims 　　Zhou Jun 　　（China Energy Construction Group construction of four Shanxi Electric Power Company Taiyuan Shanxi 030012） 　　【Abstract】For construction enterprises in the construction project management process to errors， Analysis claims the basic principles of construction enterprises. The significance of the claim and concepts are described， for todays domestic construction project claims management problems are analyzed and put forward corresponding countermeasures and suggestions. 　　【Key words】Construction claims；Claims process；Claim is based；Claims management 　　1. 引言 　　（1）在建筑工程市场上，一般称工程承包方提出的索赔为施工索赔，即由于业主或其他方面的原因致使承包者在项目施工中付出了额外的费用或造成了损失，承包商通过合法途径和程序，通过谈判、诉讼或仲裁，要求业主偿还其在施工中的费用损失。施工企业在实际施工项目管理过程中，往往出现一些观念上的误区，从而使许多应得的索赔不成功，甚至造成反索赔。 　　（2）为了顺利地进行索赔工作，施工企业提出索赔必须有充分的证据，同时必须谨慎地选择证实损失的最佳方法，并根据合同规定，及时提出索赔要求。施工企业相关人员项目管理中及时掌握施工索赔的相关知识显得至关重要。 　　2. 索赔概述 　　2.1 索赔含义。 　　2.1.1 索赔有较广泛的含义，它是索要、索付的意思，即是对自己已经受到的损失进行追索，可以概括为如下3个方面： 　　（1）一方违约使另一方蒙受损失，受损方向对方提出赔偿损失的要求。 　　（2）发生应由业主承担责任的特殊风险或遇到不利自然条件等情况，使承包商蒙受较大损失而向业主提出补偿损失要求。 　　（3）承包商本人应当获得的正当利益，由于没能及时得到监理工程师的确认和业主应给予的支付，而以正式函件向业主索赔。 　　2.1.2 索赔是一种正当的权利要求，同守约并不矛盾
