浅析我 金融消费者权益保护 ［摘要］全球性或区域性的金融危机使很多国家逐渐认识到对处于弱势地位的金融消费者 权益保护的重耍性，加强金融消费者权益保护成为金融改革的重中之重。H前，我国涉及到 保护金融消费者权益的立法落后，金融消费者概念尚未法定，金融消费者法定权利还未明晰, 缺乏明确保护金融消费者权益的立法原则，也没有专门的机构对金融消费者的权益进行保护。 本文通过学W与借鉴美国、英国等发达国家在金融消费者权益保护方面的经验，立足我国的 基木国情，明确立法思路和保护途径，努力构建适合我国金融改革与发展的金融消费者权益 保护制度框架。针对我国金融消费者权益保护的立法现状以及出现的金融消费者权益保护机 构力量薄弱、司法救济难、金融机构服务理念有待改善、消费者对金融产品的认知度较低等 问题提出建议。 ［关键字］金融消费者 权益保护 金融消费者权利 Analysis of China’s financial consumer protection [Abstract] The global financial or regional crisis, many countries in the world cone to realize the importance to protect the financial consumers who are in weak position, strengthening financial consumer protection should be the top priority of financial reform. At present, our country related to protecting the interests of financial consumers legislation lags behind, the concept of financial consumers are not legal, financial consumer legal rights are not clear, the lack of a clear legislative principle of protection of the financial interests of consumers, there is no specialized institutions for financial consumer rights protection. In this paper，through studying and drawing lessons from America, Britain and other developed countries in the experience of financial consumer protection, based on the basic conditions of our country，the legislation idea and protection ways，and strive to build a system of financial consumer protection for Chinas financial reform and development frame. According to the present situation of legislation of our financial consumer protection as well as the power of financial consumer protection, judicial relief to the weak, financial institutions need to be improved，the service concept of consumer awareness of financial products is low recommendations.
