论文题目：论船舶抵押权人利益保险问题 学 术 声 明 本人呈交的学位论文，是在导师的指导下，独立进行研究工作所取得的成果，所有数据、图片资料真实可靠。尽我所知，除文中已经注明引用的内容外，本学位论文的研究成果不包含他人享有著作权的内容。对本论文所涉及的研究工作做出贡献的其他个人和集体，均已在文中以明确的方式标明。本学位论文的知识产权归属于河北科技师范学院。 本人签名： 日期： 指导教师签名： 日期： 摘要 当下我国建立船舶抵押权人利益保险制度还存在很多问题：一、目前我国法律法规对保险标的、保险利益规定还不是很不清楚；二、船舶抵押登记制度也存在很大问题；三、当前我国急切需要确保船舶融资能够安全发展的风险控制办法等。为了可以解决这些矛盾冲突问题，本文综合了各类研究文献，提出了从保险标的、可保利益、代位求偿、告知义务等方面完善相关法律，清除制度障碍；顺应市场趋势，鼓励外资进入；对保险条款进行调整和修改等，遵守法律规定的同时也要遵循保险原理。为船舶抵押权人利益保险能够顺利引进我国给予法律保障。文本首先对船舶抵押权人利益保险的研究背景、目的、意义进行了初步的分析，其次对抵押权人利益保险概念、特征的进行了整理；然后对船舶抵押权人利益保险的法律性质做出了说明；然后分析了当前我国引进船舶抵押权人利益保险所存在的问题及有关解决建议。得出了船舶抵押权人利益保险是保障船舶融资能够安全、顺利进行的最优解决方案，当务之急是解决我国船舶抵押权人利益保险存在的问题，为引进船舶抵押权人利益保险做准备。 关键词：船舶抵押权人利益保险；船舶融资；法律性质；法律环境 Abstract The existing problems of the insurance system for the insurance of ship mortgage holders are established: first, the existing laws are not clear to the subject of insurance and the provisions of the insurance benefits;Problems in the mortgage registration system of the two ships;Third, there is an urgent need to ensure the safe development of the ships financing.To solve these conflicts, this paper studies and proposes should follow the principle of insurance both the provisions of the maritime law for insurance clauses and the law of contradiction conflict reasonable modification, makes the mortgagee interests of insurance of the introduction of laws in our country.In this paper, through the concept and characteristics of insurance to the mortgagee interests, insurance to the mortgagee interests has carried on the preliminary analysis, then discusses the mortgagee benefit insurance underwriting risk, insurance to the mortgagee interests of relevant legal nature is defined, and pointed out the insurance interests of ship mortgagee matters needing attention.It is concluded that the mortgage of the ship interests of insurance is to ensure the safety o
