施工索赔现状及对策研究 摘 要 工程索赔作为施工企业合理控制成本，提高利润的重要手段，是工程合同管理的核心内容，是衡量一个企业管理水平的重要指标，日益引起工程施工企业的重视。但当前建筑市场中施工企业过分强调索赔，导致了“低价中标，高价索赔”的策略成风，扭曲了工程索赔的本义。 本文通过分析施工企业在索赔过程中存在的问题，阐述了索赔证据的种类以及施工索赔的内容，分析了现行施工合同的特点及对索赔管理的影响，同时结合案例进行实证分析说明。最后，通过分析索赔争端的处理方式，提出了解决好索赔争端的一些建议。 关 键 词 索赔 索赔证据 索赔处理 Construction claims status and countermeasures ABSTRACT The project claim for compensation is an important means for construction enterprises to control costs and improve profits reasonably.
