论国际私法中的法律规避更新时间：2010-12-2 8:13:47 编辑：ed05 文章出处：一代论文网 引用：- - 摘要：随着现代国际民商事的交往日益增多，法律规避现象时有发生，不仅存在于亲属法、婚姻法，契约法领域，而且几乎渗透到国际私法的各个领域，诸如公司法、运输法、保险法等。法律规避现象的增多，既影响了有关国家法律的威严，与各国法律的冲突也不断增加。也不利于保护国际民商事交易安全和善意相对人的利益。关于法律规避的性质和效力，各国在理论和实践上历来存在分歧 。 法律规避作为国际私法的一项独立的制度，从实践层面讲，存在着意图认定上的主观性、效力认定上的矛盾性和处理后果上的消极性等缺陷。法律规避在性质上并非一种欺诈行为、违法行为和逃法行为，而是当事人主观能动地选法行为，这种行为具有处于合法性与违法性之间的属性，即虽不是合法行为，但也不是违法行为。正确认识法律规避制度的性质和效力等问题，在理论和实践上对正确处理我国国际私法上的法律规避问题具有重要的现实意义。 关键词：国际私法；法律规避；效力 On Private International Law in the law to circumvent Abstract: With the modern international civil and commercial exchanges between the increasing phenomenon of evasion of law have occurred, not only in family law, marriage law, contract law field, but also into almost all fields of private international law, such as company law, transport law, insurance law and so on.
