I I 观念交付制度研究 中文摘要 随着社会的发展，市场交易越来越频繁且越来越复杂，虽然简单的现实交付 作为市场经济中动产的主要交付模式，但随着市场的变化，除去现实交付以外的 动产交付模式被应用的越来越多，甚至需要立法来明确其地位、方式等问题，其 中观念交付便是动产交付方式中的一颗新星。 本文主要从五部分阐述观念交付： 第一部分概述了观念交付的概念、种类，简单的介绍了观念交付的起源以及 在我国观念交付的理论基础，引用了外国法律中观念交付的相关规定。通过这一 部分的介绍主要是让大家了解观念交付的含义以及观念交付在法律史上的演变 过程以及如今的重要作用。 第二部分主要介绍了观念交付的种类，一种是指示交付，另一种是占有改定， 还有一种是简易交付。在这三种观念交付类型中，每种类型都涉及一些细小的值 得研究的内容，比如，占有改定中的双重让与问题，观念交付的适用等问题，其 中观念交付的适用有两大部分内容，分别是动产物权设定和移转问题的适用以及 观念交付在善意取得中的适用。通过研究可以更细微的了解观念交付适用的范 围，条件等。 第三部分剖析了我国现阶段观念交付的现状，旨在发觉我国法律中观念交付 存在的缺陷和问题，以便能够能好的找到解决办法、解决途径，进而完善我国观 念交付制度。 第四部分在评析了我国观念交付的现状后，提出笔者的观点：引入间接占有 理论以及完备观念交付公示法律效力，进而完善我国观念交付理论上的支持，并 且完善公示制度，使得交易更安全、有效、便民。 关键词：占有改定 指示交付 简易交付 善意取得 动产质权 II II The concept of delivery system study Abstract With the development of society, business trade becomes increasingly frequent and complicated. Simple actual delivery acts as the main delivery mode of the movable property in the market economy. However, as the market changes, other models of the movable property delivery other than the actual delivery are being applied more frequently, and even legislation needs to be make to clarify the status and ways and other issues. Concept delivery is a new mode of movable property delivery. This article consists of four parts describing the concept delivery: The first part summarizes the concept and types of the concept delivery, generally introduce the origin of the concept delivery and its theoretical foundation in our country and refer to the relevant provisions of the concept delivery from foreign laws. Through this part’s introduction, it aims to let people know the meaning of the concept delivery and its evolution in law history, as well as the significant role of the concept delivery. The second part mainly introduces the type of the concept delivery. The concept delivery have three specific types: the instructional delivery, the alteration delivery and the simple delivery.
