摘蔓摘要 摘蔓 摘要 在目前的国际金融市场上，既能规避风险又能导致风险的国际金融衍生工 具，本身是一把“双刃剑”。国际会融衍生交易创造了空前繁荣和膨胀的会融市 场，并且在很大程度上改变了传统银行体系的经营范畴和交易规则。但是，面 对着国际金融市场的自由化、国际化趋势，金融创新导致国际金融衍生产品及 其交易R趋膨胀的状况，面对着巨大的潜伏的金融市场JxL险，埘国际金融衍生 工具交易的法律监管就显得滞后而苍白无力了。为了一国乃至全球金融和经济 秩序的稳定，如何加强和完善国际金融衍生工具的法律监管，以维持国际金融 市场的稳定又不损害金融市场的效率，是国际范围内的一个重大课题。 本文从国际金融衍生工具的基础理论着手，论证了加强国际金融衍生工具 法律监管的必要性，并对国际金融衍生工具的法律监管问题进行了深入的探讨， 构建了中国金融衍生工具法律监管制度的框架。全文共分五章。 第一章是引言，简单介绍本文的主要内容和基本框架． 第二章介绍了金融衍生工具产生和发展的原因，分析了其概念和种类，论 述了加强国际金融衍生工具法律监管的必要性。 第三章阐述了国际金融衍生工具法律监管的含义，论述了目前国际金融衍 生工具法律舱管的困难，分析了金融衍生工具法律监管模式，并进而分析了一 些国家和地区对金融衍生工其监管采取的法律措施和国际金融衍生工具法律监 管的国际合作，在此基础上，对国际金融衍生工具的法律监管趋势进行了论述。 第四章在上两章的基础上，阐述了中国发展金融衍生工具的必要性，分析 了国际金融衍生工具运用和监管现状，提出了有建设性的意见，进一步提出构 建中国金融衍生工具监管制度框架之构想。 最后一章是结论，对全文的主要观点作了概括和总结，并且展望了金融衍 生工具法律监管的未来发展目标。 关键词：国际金融衍生工具 法律监管监管模式 AbstractAbstract Abstract Abstract Presently，Derivatives which is considered a double—edged blade at the money market，dodges as well as induces risks．The exchanges of Derivatives not only bring in the booming of the money market．but also influence the business categories and rules of banking system in some extent． With the liberalization and internationalization of the money market，financial innovation brings on the inflation of the Derivatives and its bargaining．While being confronted with latent risks．the supervisory system is weak and frangible．So，how to reinforce and improve the supervisory system is a great task for maintaining the stability of the international money market． This paper，on the basis of the fundamental theory of Derivatives， emphasizes the necessity of enhancing legal supervision，probes into the problems of the legal supervision and produces the frame of the supervisory system of derivatives of China．This paper consists of five chapters． The first Chapter is the foreword．generally introduces the main content and structures． The second chapter states the reasons of origination and development of Derivatives，illustrates the concept and the classification and dissertates the necessity and stringe
