第23卷第11期 第23卷第11期 中国土地科学 V01．23 No．11 2009年1 1月 China Land Science Nov．，2009 城市老城区私房用地使用权探讨 强真1，毕继业2，杜舰t (1．中国国土资源经济研究院，北京101149；2．中国土地勘测规划院，北京100035) 摘要：研究目的：对历史遗留的城市老城区私房用地使用权定性和转让等管理制度创新进行探讨，为完善国有土地地籍 管理制度，保障私房用地权利人合法权益，健全城市土地收益分配机制提出建议。研究方法：基层调查法，归纳总结法。研 究结果：明确了城市私房用地使用权确定的复杂性和必要性，提出了城市私房用地使用权性质确定和地籍管理制度完善 的初步性建议。研究结论：应加紧出台城市老城区私房用地使用权专项法规制度，推进登记发证工作。 关键词：土地使用权；私房用地；城市；老城区；历史遗留问题 中图分类号：F301．1 文献标识码：A 文章编号：1001—8158(2009)11-0016-05 Discussion on the Land-use Right of Urban Private House in Old Built-up Zones QIANG Zhenl，BI Ji-ye2，DU Jianl (1．Chinese Academy of Land and Resource Economics，Beijing 101 149，China； 2．China Land Surveying and Planning Institute，Beijing 100035，China) Abstract：The purpose of this paper is to discuss the concept and the management system innovation the transfers of the land-use right of urban private house in old built—up zones．The existence of such private houses in current state—owned and collective—owned property settings due to the historically reserved issues．Providing policy recommendations also the aims of this paper in order to improve the national land cadastral management regulations，and protect the legal rights and interests of the private houses’owners，as well as improve the mechanism of ￡lle urban land income distribution．Methods of local surveys．induction and summarization were employed．The I'eSuhs indicate that the definition of urban private land-use right is complex and necessary．Thus，some preliminary suggestions related to defining urban private land-use right and perfecting cadastral management are brought forward． It is concluded that specialized laws and regulations of private house land—Use right in old built—up should be urgently made and the registration and certificate granting work should be accelerated． Key words：land——use right；land for private house；urban area；old built-up zone；historically reserved issues 城市老城区私房用地使用权问题是影响当前中国城市国有土地使用权权属管理、制约
