摘 摘 要 自然法思想具有悠久的历史和丰富的内涵，是西方最具影响力的法学思想。 它特别强调法的原初性价值，如理性主义、正义价值以及人本主义精神等。本文 较为全面的梳理了自然法思想的历史演变过程，介绍了分析实证法学和社会学法 学对自然法思想的质疑，发现了自然法思想自身的不足，揭示了自然法思想的强 大生命力及其现代价值。自然法思想作为西方最具影响力的一种理论，不仅对西 方国家的法治建设具有深远的影响，也是中国法治建设可以借鉴的重要思想。 本文第一部分梳理了自然法思想的历史演变过程，认为自然法思想的发展经 历了自然主义自然法、神学主义自然法、理性主义自然法和价值多元主义自然法 四个阶段，并分别介绍了各时期自然法思想产生、发展和变化的历史文化背景， 反映出了西方自然法丰富流动的理论内涵。 第二部分从分析实证法学和社会学法学对自然法思想的质疑入手，辩证地分 析了自然法学说、分析实证法学和社会学法学的利弊得失，阐明了自然法思想无 论在理论上还是实践上都存在着无法克服的缺陷，但其对西方社会仍发挥着不可 替代的作用。 第三部分总结概括出了自然法思想生命力的表现形式，即理性主义、正义价 值、平等自由、民主法治、人本主义和批判精神。 第四部分阐述了自然法思想对西方法治社会形成的影响，并从我国的传统法 制观念入手，结合当前社会的实际情况，论证了自然法思想对我国法治建设的启 示。 关键词：自然法理性正义人本主义民主法治平等自由现代价值 Ⅱ AbstractThe Abstract The western natural law theory has a long history and abundant connotation．It gives emphasis to the primitive value of law such as rationalism，the value ofjustice and the spirit of humanism．etc．This study deals wim the advantages and disadvantages ofnatural law and its powerful vitality from its development process by the criticism from analytical positivistjurisprudence and social jurispmdellce to natural law．．The natural law as a theory which has been deeply influencing the western countries will be ofgreat benefit to China’S Legal Constructiom The first part of this paper gives a broad overview of the development process of natural law．We hold the opinion that the development process ofnatural law mould be taken apart into four phr勰es—the natural law of naturalism，the natural law of theology,the natu捌law of rationalism and the multi-value natural law．In addition to this,the cultural background of the birth,the development and the change of the natural law are also introduced in this study,in which the abundant theoretical connotation ofthe naturallaw is reflected． The second part of this paper analyzes the advantages and disadvantages and the gains and losses of the naRlral law,the positivist jurisprudence and the social jurisprudance by the way ofanalyzing the positivistjurisprudanee and the query to the natural law by the social jur
