论外资银行市场准入的法律规制摘 论外资银行市场准入的法律规制 摘 要 在金融全球化和自由化条件下，构建行之有效的外资银行市场准入法律制度 对于防范金融风险和促进本国银行业的稳健发展具有重要的作用，同时也是世界 各国所面临的一个重大课题。根据我国入世所作出的承诺，到2006年年底，我国 全面开放国内银行市场，外资银行在客户服务范围、地域、本外币业务方面进入 中国市场享有与中资银行同等的待遇，不能对外资银行采用与我国入世所作承诺 相违背的限制性措施。本文通过对外资银行市场准入的基本制度、GATS框架下金 融服务法律体系和巴塞尔体制所确定的有关跨国银行监管的有关国际法规则以 及我国有关对外资银行市场准入方面的法律、法规和部门规章进行分析，指出我 国在外资银行市场准入法律制度方面所存在的一些比较重大的缺陷和问题，并提 出自己的完善建议。全文一共分为四部分： 第一部分通过对外资银行、市场准入和外资银行市场准入法律规制等概念进 行分析，以确定本文研究的范围．此外还探讨了外资银行市场准入法律规制的必 要性、目标和原则。 第二部分通过对相关国家在对外资银行市场准入形式、条件和范围方面具体 规定的比较，为我国外资银行市场准入法律制度的完善提供参考依据。 第三部分分析了WTO框架下有关外资银行市场准入的规则，以及巴塞尔委员 会所颁布的涉及外资银行市场准入的文件所确立的有关规则，为我国确立外资银 行市场准入法律制度提供了国际法意义上的法律基础。 第四部分介绍了我国外资银行市场准入立法的历史与现状，并指出了我国外 资银行市场准入制度存在的问题，最后还提出了相关的见解，指出应该在法制体 系、具体规则、监管体制和监管措施等方面进行完善。 关键词：外资银行市场准入法律规制 ON ON THE REGULATION SYSTEM OVER THE MARKET ACCESS OF FOI也IGN B枷【S ABSTRACT To establ i sh effective legal system for I眦ket access of foreign banks in the conditions of financial 910balization and 1iberalization is important for the prevention of financial risks and promoting the healthy deVelopment of the domestic banking sector，and is also a major problem for the countries of the world to face．According to China’s WTO accession commitments，by 2006，China had fully open the domestic banking舱rket， and foreign banks enjoy equal treatment to enter the Chinese market with Chinese—funded banks in geographical customer services， the foreign currency business，they would not be taken restrictive measures vi01ating our WTO co唧itments．This thesis through the analysis of the basic system of market access for foreign banks，the relevant international legal rules establ i shed by the framework of the GATS and the Basel system of transnational banking superVision and China’s market access for foreign banks in the laws and regulations，points out the more significant errors and problems existing in the 1egal system of our market access of foreign banks，and giVes some advice to improve．This thesis consists of four parts． Its abstract as f0110ws： Part I：This part
