山东大学硕士学位论文中文摘要 山东大学硕士学位论文 中文摘要 我国的检察制度有自己的特色，在人民代表大会制度下，检察权应定位于法律监 督权，检察机关应定位于专门的法律监督机关。 检察权作为一种独立的权力，有自己的运行规律，也即独立行使。这是由权力制 衡、检察职能、检察权的内容及条约必须遵守的国际义务决定的．在我国，检察权独立 行使也是实现依法治国方略、社会主义现代化以及司法的公正和效率的需要。 检察权独立的内容是丰富的，包括检察权独立、检察机关独立、检察官独立和检 察责任独立．我国的检察权独立行使存在着检察权地方化、检察机关上下级职责不明、 检察官不独立、检察责任不独立等缺失。 检察权必须独立行使。检察制度改革的方向是确保检察权独立行使。在我国，检 察权不独立原因是多方面的，必须克服检察实践中与法律规定不相符的观念，逐步改革 与检察权独立行使不相适应的法律和制度。 检察改革是渐进的，是在理想目标下的理性实践和自上而下地推进。 关键词：检察权法律监督权独立检察改革 商乏圣． ／ ’砂矾．“．j，6 山东大学硕士学位论文ABSTRACT 山东大学硕士学位论文 ABSTRACT China's procurator system has its own characteristics．Under the People's Congress system,procuratorial power should be defined as law to supervise，Procuratorial organs should be defmed as organs with power ofspecial legal supervision． Procuratorial powers as all independent power has its own operation discipline,namely the independent exercise．This is determined by the power of checks and balances, prosecutorial fimctions，procuratorial powers and the content mast comply with international treaty obligations decision．In our country,but also for the independent exercise of procuratorial strategy of ruling the country by law and socialist modernization and the need forjudicial fairness and efficiency． Independent content of procuratorial powers is rich,including prosecutorial independence，the procuratorial organs independence，the independence ofthe Prosecutor and the Public Prosecutor's responsibility independence．China's independent exercise of procuratorial powers has deficiencies such船local procuratorial powers and unknown procuratorial organs of the lower duties,the independent Prosecutor,and independent responsibility of． Procuratorial powers have to be exercised independently．The direction ofthe reform is to ensure that the procuratorial powers are exercised independently．In China,reasons for procuratorial powers being independent are many．The prosecution must ova-c,omc the practice being incompatible with the concept of law,and gradually reform the laws and regulations that don
