摘要摘要 摘要 摘要 森林作为陆地生态系统的主体，对于维护生态平衡、促进社会经济持续发展和改善 人民生活水平等都具有重要意义，其不仅是人类文明的摇篮更是现代文明的重要标志。 但由于种种原因我们的家园遭到了极其严重的破坏，据联合国粮农组织(FAO)评估， 1980。1990年，全球发展中国家和地区的森林和其他林地面积每年减少10x106hm2以 上，专家预言，21世纪生态危机将有可能成为人类面临的最大威胁，森林的兴衰成为世 人瞩目的焦点。中国原本就是一个典型的少林国家，森林覆盖率和人均拥有森林面积排 名世界120名之后，中国又是一个发展中国家，因此它面临的是森林保护与经济发展的 双重压力，在这种形势下中国政府领导全国人民奋起抗争，确定了以大工程带动大发展 的发展模式和林业跨越式发展的战略目标，这是一个全新的建设道路和发展模式，因此 旧的经营利用森林的法律制度已经不能适应林业跨越式发展的需要，有的甚至已经成为 林业发展的障碍。 本文『F是基于这一状况， 以森林分类经营为基础，对我国的森林经营法律制度进 行研究，并借鉴国外林业发达国家的经验教训，提出对我国森林经营法律制度变革的几 点建议，以利于我国能够顺利走过林业跨越式发展道路，实现林业可持续发展的目标。 关键词森林分类经营；公益林；商鼎林 AbstractAs Abstract As the subject of the land ecosystem forestry is significant in safeguarding the ecological balance，promoting the sustained development of society and economy and improving the living standards of the people etc，which is the important sign of modem civilization as well as the cradle of human civilization． But our home has been destroyed seriously for a variety of reasons．According to the assessment of FAO，the forest and other forest land of global developing country reduced more than lOxl06hm。every year in 1980～1990．And the specialist prophesied that ecology crisis is becoming the threaten most in 21 century．So the rise and decline of forest is focusing common people’S attention upon．China is a classical country lack of forest which is arranged behind 120 on the forest coverage rate and the forest area possessed by averaging people．And china is also a developing country which is facing the double pressure of protecting forest and developing economy．In this situation Chinese government leading the people of the whole country determines the development model of large project promoting large development and the strategic goal of the forestry great·-leap·-forward development，which is a new construct way and development model．So the old law system about forestry management has not be suitable for the demand of the forestry great-·leap-· forward development，some of which have even been the barrier of forestry d
