摘 摘 要 植物新品种的保护关系到一个国家、地区、企业的经济发展和科技发展水平， 农业作为人类赖以生存的产业，逐步成为一’个更为开放世界竞争的热点。我国是 ～个农业大国，是国民经济的基础，涉及到社会稳定和人民生活安全的问题。面 对植物新品种保护意识淡薄、市场管理混乱，执法不力，品种繁殖材料(种子) 保密难，易被窃取等情况，我们必须建立植物新品种保护体系，保护我们的民族 精品和丰富的物种资源，保护科技工作者的切身利益。从根本上解决我国的“三 农”问题，增强国际竞争力起着重要的作J日。 本文从介绍植物新品种保护制度的起源及发展入手，展望新世纪国际植物新 品种保护的发展趋势以及我国目前植物新品种保护制度取得一些成就，与自己 比，有进步，与国际比，有相当大的差距。然后运JE}；|比较分析的方法，对植物新 品种保护特征，保护价值和内容、模式，授予的条件等进行分析和探索，最后， 针对目前我国植物新品种保护的状况以及存在的主要问题，提出保护对策的建 议：通过法律法规的学习和宣传，提高整个社会的植物新品种保护意识；加大执 法力度，规范市场，依法保护育种者的权益；健全保护体系，改善植物新品种保 护制度的实施环境；积极开展国际交流和新品种研究，使更多的育种新成果适应 我国农业发展新阶段的需要。从而为理论上和实践中对如何保护植物新品种提供 依据和参考。 关键词：植物新品种；知识产权；保护机制 AbstractThe Abstract The protection of new plant variety has bearing the economic development and the science and technology advance of count／y,a region company Agriculture，an industry vital to people’S livelihood，has become hot spot for the world competition China is big agricultural county but agriculture is at disadvantageous position though it is the foundation of our nation’S economy and concerns with the social stability and safety of people’S life，At present，there many problems found in new plant variety protection：the low protection awareness， the disorder in market management，flail implementation of Iaw,the difficulty in secrecy of multiplying seeds Therefore，we must build up new plant varieties protection institution SO to protect superior product，to protect rich plant varieties and the profit ofscientific and technical workers in this field This institution also plays important role in helping to solve those problems concerning agriculture， countryside and farmers and strengthening the competitiveness in world market This paper firstly introduced the origin and development of the protection institution of new plant variety,look ahead into its trend of development globally in the new Then the author analyzed the progresses in recent years and deficiencies in the protection of new plant varieties in China when compared with some foreign countries It warns that in the intel
